1. Ownership

1.1 This site is owned and operated by Greenweez SA. Our registered office is at 301 rue des Marais, 74410 Saint Jorioz, France under number 508 047 859. VAT number: FR49508047859.

These terms and conditions apply to your use of this website, including any orders that you place on www.greenweez.eu. Please read these terms carefully before using this website. Using this website indicates that you fully accept these terms regardless of whether or not you choose to register with us. If you do not accept these terms, do not use this website.

1.2 All rights in this website are owned by us. Any unauthorized use, copying or modification is prohibited.

1.3 We reserve the right to make changes to these terms and conditions in the future. Any changes will be posted to the site and will take effect immediately. You should, therefore, read the terms and conditions each time you access this website.

2. Products and Pricing

2.1 Products

In accordance with Article L. 111-1 of the Consumer Code, you may, prior to your order, take note on the Greenweez website of the essential characteristics of the product(s) you wish to order.

Please note that some products' packaging and / or user manuals do not come in English or in the language of your country. Some products come with 2-pin plugs. Adapters from European to UK plugs will not be supplied with your order.

Any advice or recommendation given by Greenweez or its employees to you as to the storage, application or use of the products which is not confirmed in writing by the us is followed or acted upon entirely at your own risk, and accordingly we shall not be liable for any such advice or recommendation which is not so confirmed.

All deals offered by Greenweez are only valid while supplies last.

Certain products are subject to age restrictions as indicated on the product page. By placing your order for any of these products, you confirm that you have reached the required age. Your entire order will be cancelled if we are unable able to verify your age using the details you have submitted. Under Article L. 3342-1 of the Public Health, alcohol can only be purchased by and for individuals aged 18 or over and liqueur chocolates can only be purchased by or for individuals aged 16 or over.

Greenweez may terminate or suspend the supply of any goods displayed on the website in the event of out of stocks, for support or maintenance work, in order to update content or for any other reason. Greenweez.eu may do this at any time and without notice.

2.2 Pricing

Prices shown on the website are in Euros and offers remain valid as advertised from time to time. Greenweez.eu reserves the right to change its prices at any time but products are invoiced at the price applicable when the order is registered.

We do our best to make sure that prices are correctly shown but very occasionally an error may occur. We will not accept an order if there is a pricing error.

Prices do not include delivery charges. Delivery charges are shown to you as products are selected and are invoiced at the end of the order in addition to the price of selected products.

All items are subject to VAT at the prevailing rate in France. The VAT inclusive amount is included in the total price published on the site. We reserve the right to raise our prices in line with any increase in the prevailing rate of VAT. This will be shown clearly on your order.

We reserve the right to change prices if there is a change in the VAT rate. These changes may be passed on in the price of the items without previously informing the customer.

Offers are intended solely for consumers with a delivery address within the Eurozone: Germany, Austria, Belgium, Luxembourg, the United Kingdom, the Netherlands, Switzerland, Ireland, Spain, Portugal and Italy. Postal addresses in the Isle of Mann, Jersey, Guernsey, the Canary Islands, Ceuta & Melilla, Madeira and the Azores are not covered by our delivery services.

2.3 Right to limit order quantities

When a buyer, such as a professional buyer, orders a large quantity of a product, Greenweez reserves the right to cancel the order to maintain the stock levels on the website. Then, Greenweez may ask the buyer to use the Request for Quotation service. Pricing and delivery conditions may differ from those described on the website.

2.4 Products temporarily and permanently out of stock

Greenweez reserves the right to cancel or partially or entirely refund an order if one or several items are temporarily or permanently out of stock. In such case, you will be informed as soon as possible. If any item you have chosen is unavailable, Greenweez will offer you a replacement product. Of course, you will have the right to accept or deny this replacement.

2.5 Order confirmation

The contract between you and Greenweez is only formed when you click the "Confirm your order" button and after a summary of your order has been displayed. This step during checkout gives you the opportunity to see the pricing details of your order as well as to correct any occuring mistakes.

2.6 Sales order archives

All contracts concluded on our website, including the order's collected data and the applicable terms and conditions at the date of your order, are archived for a period of 10 years. You can access your purchase orders' archives by sending an email to our Customer service team at customerservice@greenweez.com or by post mail.

3. Ordering goods

If you do not agree with this Terms & Conditions, do not order any goods from Greenweez.eu. If we accept any order for goods from you, then its agreement with you will be made on these Terms & Conditions.

When you submit an order to us on our website you will receive a confirmatory email of this order saying that we are processing your order. You will then receive a second email from us acknowledging your order and giving you estimated timescales for delivery. You should check both emails for accuracy and let us know immediately if there are any errors.

Your order represents an offer to us to purchase a product which is accepted by us when we send e-mail confirmation to you that we have dispatched that product to you. That acceptance will be complete at the time we send the dispatch confirmation e-mail to you. Any products on the same order which we have not confirmed in a dispatch confirmation e-mail to have been dispatched do not form part of that contract.

The sale is considered as complete when your order is accepted by us and after full receipt of your payment. If we encounter technical difficulties while processing your order, we reserve the right to either cancel or refund your order in order to fix the problem.

4. Payment

4.1 Payment methods

Payment may be made by the methods indicated on our website. We accept immediate payment using Credit or Debit Card: Visa, Mastercard and Amercian Express. You can also pay your order by PayPal, using your PayPal account.

Payment is due upon order placement. If you would like to pay by bank transfer, we are happy to accept payment this way. Please note that orders will not be dispatched until the payment has been cleared. This can sometimes take several days, that is why we recommend you to make payments by credit card.

4.2 Data protection

All confidential banking data that you communicate for the purpose of product payment is managed directly by our financial partner via its encrypted site. Confidential data is encrypted and sent directly to the bank server without passing through the Greenweez server.We have no visibility nor access to this confidential data.

4.3 Payment verification

In certain circumstances, we reserve the right to request additional documentation to confirm the payment of your order. If you do not provide the requested documents, or refuse to do so, Greenweez also reserves the right to cancel your order in case of reasonable doubt as to its authenticity and reliability.

If we believe that you paid or are attempting to pay with fraudulent funds, using stolen credit card numbers and information, we also reserve the right to report the authorities information about fraudulent payments.

4.4 VAT

Prices include the Value Added Tax (VAT) applicable in the E.U. on the day of the order. All additional taxes connected to the sale and/or delivery of the order (in particular all customs duties) are the sole responsibility of the buyer.

4.5 Default of payment

In certain circumstances, we reserve the right to refuse to honour an order placed by a consumer that has not totally or partially paid a preceding order or with whom a payment dispute is being handled.

In case your payment has been refused by your bank (payment rejected, over limit on your credit card), you are required to make another payment within 7 calendar days. You may then be subject to late payment penalties with a 10% interest rate calculated on the total amount of your order from the date your payment was rejected.

In case a collection action is required by Greenweez, all costs incurred will be charged back to you, including unpaid fees and charges, bailiffs' charges or judicial expenses.

5. Delivery

5.1 Delivery charges

Orders will be delivered to the address indicated on the registration form that you complete during the order process. It is your responsibility to ensure the delivery address is ready and able to accept delivery of the product, in particular that there is space for any delivery vehicle to make the delivery.

Some postal addresses may not be covered by our delivery services and we may not be able to arrange delivery of some items to such addresses. You will be notified of this when you place your order.

A delivery date is given to the Buyer when registering the order, before the order confirmation. The delivery date depends on the availability of the products (which may vary from one product to another) as well as on the delivery method.

Shipping charges depend on the delivery method, destination and weight of the package. Information regarding the shipping charges Germany, Austria, Belgium, Luxembourg, the United Kingdom (excl. the Isle of Mann, Jersey & Guernsey), the Netherlands, Switzerland, Ireland, Spain (excl. the Canary Islands, Ceuta and Melilla), Portugal (excl. Madeira and the Azores) and Italy are available here. Specific charges apply to other destinations and also depend on the shipping method and weight of the package. You will always be informed of the shipping charges before the order confirmation.

Please note that Greenweez reserves the right to split the deliveries.

5.2 Shipping delay

In compliance with the Law on Consumption of 17 March 2014, in case of delay in the delivery of the order, you may enjoin us to deliver the goods within a reasonable period of time starting from the first day after the delivery date indicated when placing your order. To do so, you should notify us by email at customerservice@greenweez.com or by post. If the reasonable time limit specified is exceeded, you may inform us with another email of your decision to withdraw from the contract.

The withdrawal from the contract should take place within sixty working days from the deadline for delivery.

The contract will be cancelled upon receipt of the second e-mail or postal mail, if the order was not delivered during the period between the shipment and the receipt of the mail.

The sale cancellation, in accordance with the terms and conditions mentioned in the previous article, compels the Seller to refund the total payment to the Buyer, within a maximum period of fourteen days after the termination of the contract.
The Seller cannot be held responsible if the non-execution or defective execution of the contract is imputable to the Buyer, to a third party in the contract, or is due to a case of force majeure.
If the package could not be delivered because of one or several mistakes made by the Buyer in the indication of the shipping address, the latter should repay the shipping charges for a reshipment of the package.

5.3 Signed & Tracked home delivery

When selecting a shipping method for the order, the Buyer must choose the home delivery option, against signature.

Delivery by carrier:

The order is delivered by carrier against signature at the shipping address indicated while placing your order.

In the event of the your absence at the time of the delivery, a delivery note will be left to the address, specifying a new delivery date or the information related to the shipment: the package may be delivered to a third party (caretaker, neighbour), at an affiliated pick-up location or at the carrier’s store.

Upon receipt, you must make sure that the package is in good condition before signing the delivery slip (paper or electronic), any damaged package or product should be refused and the mention "Refusal for damage goods" written on the delivery slip. However, in cases where the carrier did not allow you to open the package, or if the package was delivered to a third party, you can notify our Customer service of any defect by email at customerservice@greenweez.com within 72 hours. The order reference number as well as a precise description of the condition of your order and the damaged products will be required.

5.4 Error in the delivery address when placing the order

If the shipping address indicated while placing the order contains any mistake, you have to contact the Greenweez Customer service in order to rectify it via the online contact form selecting the subject: "Change of address". Any request not made through this form using the methods described above will not be taken into account.

If your request takes place less than 2 working days before the shipment of the order, Greenweez should not be held responsible for the non-rectification of this mistake in the shipping address. Thus, if the package is returned to Greenweez because the shipping address indicated was not correct, and no rectification request was made more than 2 working days before the shipment of the package, the reshipment to the correct address will be charged to you as an extra fee. Additionally, if there was a mistake in the shipping address indicated when placing the order, there will be no refund for the shipping charges.

5.5 Package weight

Greenweez reserves the right to refuse orders that weigh more than 30 kilos.

6. Products availability

All orders are subject to the availability of the ordered product(s), a condition that the buyer fully accepts in accordance with the stated Terms & Conditions.

You will be informed as soon as possible if, for any reason, an item currently out of stock is purchased. In this case, in compliance with the Articles L. 121-20-3 of the Consumer Code, Greenweez can provide you with a product of equivalent quality and value. The return postage costs pertaining to such a replacement product, in the event that you use your right of withdrawal, provided for in article 10 hereunder, will be charged to Greenweez.

If we cannot provide a replacement product, you will get a full refund no later than 30 days after the initial payment. No further compensation of any kind will be granted.

7. Receipt of the order

Greenweez provides you with a reminder of a legal guarantee of conformity for goods, provided in articles L 211-1 and following of the Consumer Code.

You should carefully check the products upon delivery to ensure that they are in satisfactory condition, in accordance with their description and complete before signing the delivery receipt.

If some of the products are damaged or missing in the package, you must inform our Customer service within 72 hours, by post at: "Greenweez, Customer Service, 301 Rue des Marais, 74410 Saint Jorioz, France" or by email at customerservice@greenweez.com. In any case, it is also recommended to inform Greenweez by email at customerservice@greenweez.com, attaching the order reference number as well as a precise description of the condition of your order and the damaged products.

The Buyer will then have to comply with the following procedure:
- Send, with the receipt, by registered parcel the non-compliant products to Entrepôt Deret on behalf of Greenweez, 645 rue des châtaigniers, Bâtiment E-porte 24, 45770 Saran, France. In case of a non-established and recognized compliance by Greenweez, the cost of returning the products will be our responsibility. Greenweez can provide in some cases a return label for the customer not to pay for return shipping costs.
- Forward the invoice in the package of the returned product, or in case of a gift issued without an invoice, the delivery receipt of such product, as well as the return form that has been previously completed online.

If the non-compliance or missing part is actually established, Greenweez will be sent a new shipment of conforming goods. If any complying good is available, the customer will be refunded the total amount of the order, including shipping charges.

All returned products must be sent in their original packaging, along with the invoice. For more information about our return policy, please visit our Returns section.

8. Return of faulty products (excluding damaged products during delivery)

All defective products can be returned for exchange under the conditions described below. To be approved, the return must:

- Be processed after contacting Greenweez After-Sales service who has previously indicated to the customer a return address for the faulty or defective products.
- Be sent as soon as the defect has been noticed, by registered letter with acknowledgment of receipt to the address indicated by Greenweez Customer Support under the contact as described above. If the customer is a professional, the letter must be sent no later than the 15th day after delivery. Collect consignments freight will not be accepted.
- Be accompanied by the invoice of the returned product(s), or in case of an issued gift without an invoice, the delivery receipt of the product(s), as well as the return form that has previously been completed online.

If the default subject of the claim, after verification by its technical services and whether the warranty applies, is duly approved by the Seller, the return shipping costs will be in accordance with the law. If the default subject of the claim is not approved by the Seller, or if the warranty does not apply, the return will be done by the Buyer.

To be admitted in return, the products must imperatively be returned with their original packaging, accessories and instructions.
When returning an unserviceable product, Greenweez will indemnify you on the basis of the initial value minus a predetermined of 1% obsolescence per month from the date of purchase.

If applicable, Greenweez will comply with its legal obligations on legal guarantees on hidden defects.

9. Right of withdrawal

9.1 Conditions of the Right of withdrawal

This article is exclusively for customers deemed to be "consumers" within the meaning of the provisions of the Consumer Code - excluding, correspondingly, any informed professional.

In accordance with the article L 121-21-4 of the Consumer Code, in case of the withdrawal of the consumer, the seller must refund the shipping charges. The seller is not required to reimburse additional costs if the consumer has chosen a delivery method more expansive than the standard delivery method offered by the seller.

In case of withdrawal, the consumer will bear the cost of returning the goods. If the parcel weighs more than 30 kilos, the return cost may vary depending on the chosen carrier.

If, for any reason, you wish to do so, you have the right to cancel any order you have placed. Once your order has been delivered to you, you may notify us of your will to cancel the order up to 14 working days.

You must exercise his right of withdrawal in writing via the withdrawal form (go to "My Account" > "Order Tracking" > "Return an item"). After approval by our Customer Service we will confirm the receipt of your withdrawal request by email.
In case of an order of several products, the withdrawal period will be effective from the receipt of the last product.

In the 14 days after the transmission of the customer's will to withdraw, the products must be returned with all the original elements (packaging, accessories, notice), accompanied by the invoice and the return form that has previously been completed online.

In the case where the products have already been used, you agree to clean any usage tracks.

Since those products have been unsealed, the consumer's right to withdrawal disappears altogether in the case of audio and video recordings (especially all CDs or DVDs), perishable goods, alcoholic beverages, as well as underwear, swimwear and beauty products for hygienic reasons.

The consumer's liability shall be incurred in the event of impairment of property resulting from the handling other than those necessary to establish the nature, characteristics and functioning of such property, provided that the seller has informed the consumer of his right of withdrawal, under paragraph 2 of I of Article L. 121-17.

Any incomplete or damaged good will not be refunded or exchanged. Return costs are the exclusive responsibility of the customer.
Upon exercise of the right of withdrawal by the customer, Greenweez has 14 days to refund your order. Please note that we might defer the refund until receiving the goods or the proof that the products have been returned to us.

The refund will be made either by re-crediting the credit card used for the original order or by sending a voucher if this is the costumer's wish. The refund will incur no additional costs.

Subject to the conditions mentioned above, the returned products must be sent by registered letter with acknowledgment of receipt to Entrepôt Deret on behalf of Greenweez, 645 rue des châtaigniers, Bâtiment E-porte 24, 45770 Saran, France accompanied by the invoice and the return form.

9.2 Returns processed outside the conditions of withdrawal

In case one of the conditions of the right of withdrawal described in 9.1 is not respected (incomplete product, damaged, missing notice or accessory, delay of the right of withdrawal and return not respected...), the product will not be exchanged nor refunded. Greenweez can return the product to the customer against payment of the delivery amount that will be indicated to the customer by Greenweez Customer support service.

If the customer refuses to pay the necessary charges: after a period of two months following the first customer service notification on the amount to pay in order to receive the product, the customer will see his product delivered only after having paid the correct delivery and storage fees equal to (number of storage months after the two moths delay) multiplied by 0.08 of the VAT product value.

10. Property rights

All products sold on Greenweez.eu are the property of Greenweez SA, and remain the property of Greenweez SA until full payment (including delivery charges and custom duties where applicable) has been received. Until full payment has been received, you are strictly forbidden to transform, re-sell, or pawn the products under penalty of immediate claim by us with all expenses for restitution of the product being your exclusive responsibility.

11. Responsibility

The website, its contents and any contracts formed as a result of its use shall be governed by and construed in accordance with French law and shall be subject to the exclusive jurisdiction of the French courts.

We cannot be held responsible for non-execution of a sale in the event of force majeure, or any disturbance or strike, however small or temporary, of the services of distribution, in particular postal and/or other means of transport or communication. Greenweez will not, in any case, be responsible for damages that occur after the purchase and use of a product, and will not be held responsible for replacement or compensation.

Responsibility to the contract and transport risks:
In the case of a B2C e-commerce delivery, Greenweez bears the risk until the product is delivered to the consumer.
In the case of the online professional sales (B2B), the risk transfer will occur as soon as the product is in the hands of the carrier.

12. Severance

The parties agree that in the event of one or more clauses or sub-clauses of this contract being subsequently declared invalid or unenforceable by a court or other authority with jurisdiction, the invalidity or unenforceability of any clause or sub-clause shall not in any way affect the validity or enforceability of any other clause or sub-clause except those which compromise an integral part of it or are otherwise clearly inseparable.

13. Applicable law

The sales contracts made on the Site, in accordance with these terms and conditions, are exclusively subject to the French law.

Any dispute relating to the conclusion, interpretation, performance or breach of a sale between the parties and, more generally, any dispute arising in connection with such sale shall be within the exclusive jurisdiction of any court authorized by law to sort a dispute in connection with such sale.
However, in the case of a professional Buyer, any dispute arising in connection with such sale shall be the exclusive jurisdiction of the courts of Annecy and conducted in French.

As a reminder, a cookie is a small file containing a short string of letters and numbers and is stored on your web browser or the hard drive of your computer. Its purpose is to remember information about you, similar to a preference file created by a software application.

    The time before delivery includes the shipment and delivery periods.

    It is prohibited to buy a gift voucher with another gift voucher.
